Dear Patricia Fusco,



I recently inquired about a job with your company, Fusco Personnel, by email. You called me on 3/23, and set up the interview for Thursday, 3/24 at 10 am. I was given the website address by your office, and was advised to take a look before the interview took place. When I got home that night, I took a look. I realized that I had interviewed for this company before, 3 years earlier. I dont recall if I turned down the position, or if I didnt meet what they were looking for, but I knew that I did not want to interview with them again. I called about 10:30 in the evening, and left a message on the general voice mailbox for Fusco Personnel. Stating that I was calling to let you know I wouldnt be doing the interview in the morning, for the reasons previously stated.



Thursday morning I received a voicemail at approx. 11m, from you, asking if I was showing up for the interview, "because you havent showed up yet". I was sitting in a court session with a friend, and didn't get the voicemail until 2 pm. I received 5 calls from you between 11am and 1pm. You were calling me from your cell phone, which showed up as "Restricted". I do not pick up restricted calls, because they are usually unimportant. I answered when you called at 1:48, because I figured it might be something. You asked me where I was, I stated that I left a voicemail for you, stating the reasons why. You essentially told me I was "Lying", in a sarcastic tone, and asked me "If I was still looking for employment in the executive level". I said "Yes". I told you I was no longer working in my current office, that I was brokering from home. That I no longer worked in the office, but was still employed by them. You stated "We called, and they said you havent been there in months.......you no longer work there". I asked you when you did the check, because I didnt authorize you to do so, and you stated "....a couple of days ago". That would be at least a day before you set up the interview. I thought the whole phone call was odd, why would a woman who works for Fusco Personnel be calling me from her car? I could hear the car door when it was jarred open, as well as you going through your purse.



After that, I called Fusco Personnel directly. I was told by your admin that "Someone from Fusco will never call you from a cell phone, they would call you from this number directlly". I left a message, and you called back 10 minutes later. Stating that it was you that I talked to earlier, and "what was the problem". My problem is that I didnt tell you it was okay to do so. You stated that I gave consent for you to contact previous employers when I filled out your online application in 2007. 2007! Seriously, are you trying to tell me, that I gave you consent to contact my current employer in 2007, when I didnt start working for them until late 2009? I went through the process again that you have set up online, an it only asks for who the employers are, not if you could contact them.



Lets be clear : I did not give you written consent to contact my current employer. According to the NYS Department of Labor, I need to do that. Its the law in New York state.



Your story and excuses were dazzling, and you seemed to try and baffle me with alot of crap, but, again : I did not give you permission to contact my current employer, who does not know I am seeking employment elsewhere.



I was relaying the story to my boyfriends mother at dinner thsi evening, and she stated that her company uses you all the time. I guess not anymore. You should be a little better with your Human Resource department, its failing. As well as breaking the law.



At the least, I am owed an apology for your bad business practice, and will be contacting the Department of Labor directly!
