Child Support
The amount that’s subject to the garnishment is set by Federal law. Usually its set at a percentage of your after tax income. The amount for most debt is 25%. Problem is that certain debt is handled differently. An example of the this is past due child support. If the child support is reduced to a judgement the court will allow as much as 50% of your after tax wages to be garnished.
Child Custody and Visitation
Spousal Support
The bankruptcy court cannot take all of your monetary assets. You are entitles to keep 75% of your wage earnings in the last 90 days. Further, alimony, retirement plans established after 1987, any earned tax credit, interest in an established Oklahoma College Savings Plan and interested in a lawsuit up to $50,000 are exempt.

Workers Compensation
Injury Settlement Money in Bankruptcy limits the workers compensation and personal injury settlement amounts that are exempt. In Oklahoma, your settlement from an Oklahoma work comp Injury case is exempt up-to $50,000. Also, In an Oklahoma personal injury settlement, the same cap of $50,000. applies. The real trap in this exemption is what you do with the settlement proceeds once received. If you commingle the settlement funds with other funds you could potential lose them.

This means that the money you get is not going to be lost in bankruptcy but, it must be handled correctly. Awards are also exempt. But, once again, its important that the proceeds are treated correctly. The biggest issue I see with Social Security disability awards is that the recipient co-mingles the funds.
