Bert has achieved the highest ranking from the Martindale-Hubbell rating organization (AV). He practices primarily insurance regulatory, administrative, pharmacy and business law. Bert has substantial experience in the field of insurance as evidenced by his education and employment history. He graduated with honors from Florida State University in 1993 with a degree in Risk Management and Insurance. While attending Florida State University, Bert was employed by a Lloyd’s of London broker to assist in the placement of risks and the administration of claims in the London market. In 1995, Bert worked in Legal Services at the Florida Department of Insurance and during his employment gained insight into Florida’s insurance regulatory process.

Mr. Lunny practices labor and employment law, commercial litigation, corporate law and government affairs. In his labor and employment practice, Mr. Lunny represents management and has extensive experience assisting clients in the resolution of issues that arise in all phases of the employment relationship including hiring, wage and hour, discipline, severance and termination concerns. Mr. Lunny represents public and private sector employers in all forms of employment related litigation, including breach of non-competition agreements, trade secret concerns, Fair Labor Standards Act litigation and the defense of race, age, disability, pregnancy, gender discrimination/sexual harassment and whistleblower claims. He conducts training sessions for management personnel and has frequently been an author and lecturer on employment law issues.

Construction Litigation
There is no substitute for experience. At Radey, our most senior litigators each have over 28 years of individual experience in handling a broad range of commercial litigation in federal courts, state courts and administrative proceedings. Our experience in complex commercial litigation covers a wide range of industries and topics, including insurance regulatory litigation, bad faith and coverage litigation, telecommunication and utility disputes, antitrust, construction claims involving delay damages and inefficiency claims, health care, reinsurance, suretyship issues in bankruptcy and other contexts, claims under state and federal RICO statutes, civil theft, fraud, legal malpractice, constitutional issues and litigation arising from regulatory activities of state, federal and local agencies.
Eminent Domain
During his four years in private practice, Drew concentrated on administrative law and civil litigation during which time he represented both public and private clients in matters ranging from eminent domain proceedings to civil rights violations to simple torts and general land use matters.

Personal Injury
The Florida Office of Insurance Regulation released an actuarial report written by Pinnacle Actuarial Resources, Inc. (Pinnacle) that calculates indicated savings to be realized by insurers writing Personal Injury Protection (PIP) auto insurance in Florida.
Disability Discrimination
The centerpiece of the firm’s labor and employment practice is the defense of management in employment litigation. We have defended both public and private employers from individual employee claims of age, race, gender, religion, pregnancy and disability discrimination suits.

Tax Law
For our insurance clients, Radey lawyers have assisted in all aspects of the Insurance Premium Tax and related tax issues. We have assisted clients in determining amounts subject to the premium tax as well as credits available for reducing the tax. We also have guided insurers in understanding the relationship between Florida’s reemployment tax and the salary credit against the Insurance Premium Tax. Our services on behalf of insurers have included consulting and transactional work, representation in audits, challenges to assessments and tax rules, and mediations of tax disputes. In these representations, we have achieved changes to the interpretations of tax laws that continue to benefit insurers doing business in Florida. In addition, Radey lawyers have experience with complex insurance-related tax issues such as the application of the retaliatory tax and the allocation of state fire marshal taxes.
