Medicaid Planning
First a word of caution about Medicaid Planning lawyers. Medicaid laws and regulations are extremely complex, and experience in the field is very important. Many rules are not written, and others change without notice. If a lawyer says he or she is a Medicaid Planner or does Medicaid Planning, you should be cautious. Medicaid is only a one aspect of a proper Long Term Care Plan. In fact it may not even be appropriate for some Long Term Care Plans. Medicaid is tightly interwoven with Medicare Law, Social Security Law, Veteran’s Benefits, Tax Law, Estate Planning, Disability Law, Incapacity, Nursing Home Law, Insurance Law, Health Care Law, Real Estate Law, and Probate law. In order to properly prepare for and fund a Long Term Care Plan; whether in a Nursing Home, Assisted Living Facility, or at Home; one must maximize all available benefits, without offsetting the benefits obtained by cost in other areas, like TAXES. An attorney cannot reasonably formulate a proper Long Term Care Plan, without knowledge of all of these areas. Estate Planning
Payne, Black & Pickelsimer, LLC frequently consults with the husbands or wives of disabled persons. Many times these individuals are in a nursing home, or facing nursing home care. We can show a concerned spouse how to structure their estate planning documents in a way that should they predecease their spouse, the assets can be used for the surviving spouse's benefit without risking a loss of Medicaid or other public benefits.
Wills
We understand that relationships are complicated, and family relationships are the most complicated. While we all hope to minimize disputes with family members, they are inevitable. When those times arise you need legal counsel to assure your rights are protected. Our firm has experience in complex family litigation related to estates, will contests, and guardianship actions. We assist our clients in working through these family disputes and if necessary represent them in litigation before the Probate Court or any higher level court, or mediation.
Trusts
To be successful an Estate Plan, must take into consideration, who the client wishes to receive the assets, family conflicts likely to result post death, the needs of potential beneficiaries for assistance in management of assets, the financial stability of potential beneficiaries, estate and gift tax implications of the plan, and the mental abilities of potential beneficiaries. The plan should also take into consideration ways to minimize the cost of administration, such as possibly avoiding probate by the use of living trusts, using joint tenants with right of survivorship on deeds and accounts, and minimizing conflict among surviving family members.
Power of Attorney
Janice brought her mother to see us. Mrs. Thomas had been diagnosed with the early stages of Alzheimer’s disease about a year earlier, and now the effects of the illness were really beginning to show. The last time Mrs. Thomas had been to see a lawyer was about 15 years ago, before her husband died. At the time she did a basic will and a power of attorney. Janice was willing to help with her mother’s care, but wanted to be sure she had sufficient assets to cover her needs, and that she could access those assets to provide for her care. Mrs. Thompson wants to stay in her home as long as possible and Janice wants to do what she can to accomodate her mothers needs, but is concerned about the effect this will have on her family, financially and emotionally; not to mention Janice's job.
