Divorce
A military divorce is identical to a regular divorce. The only difference is that the parties divide a military retirement, potential relocation that may affect the children, deployment that may affect the time sharing schedule, and military benefits for the non military spouse. Child Support
Child support is mandatory and cannot be waived by the parties except in certain limited circumstances. The calculation of child support is based upon the â€œnet incomeâ€ of each parent. Net income is gross income less any deductions allowed under the statute. Child support can be paid directly to the receiving party or through the State of Florida. Florida law requires that child support be paid by income deduction order if a party is ever late on child support. The child support amount includes the amounts for health insurance for the minor child/children and any daycare or aftercare amounts.

Paternity
Spousal Support
Alimony paid by one spouse to the other for life or until the receiving spouse marries or dies. Permanent Periodic Alimony can also be terminated if the receiving spouse is cohabitating with a person of the opposite sex provided the arrangements meet certain statutory criteria. The amount of alimony paid depends on the facts of the case.
Legal Separation
Florida has jurisdiction over a dissolution of marriage if one party has been a resident of Florida for at least six (6) months. Florida does not have legal separations and you are not required to be separated prior to filing a dissolution of marriage.

Tax Law
Currently, alimony payments that paid are tax deductible to the payor and taxable to the payee. Which means that if the payor pays $1,000.00 per month, then the payor will have a reduction to annual income of $12,000.00 and the payee will have to claim $12,000.00 as income. Under the new tax law, for divorces finalized in 2019 and after, the payor will no longer receive a deduction for the payment of alimony and the alimony will not be treated as income to the payee.
