Child Abuse
The lawsuit involved claims of child abuse committed by a pastor that occurred during church-based camp activities. We obtained a dismissal of all counts for abuse filed by all plaintiffs against our client, one of the church defendants. Our client did not employ the pastor when the abuse occurred and had no knowledge of the claims asserted.

Defended a national fast food retailer in the Court of Common Pleas of Philadelphia. Plaintiff alleged negligent hiring, negligent retention, and failure to properly supervise. The co-defendant employee falsified his employment application and failed to disclose that he had been convicted of armed robbery. He thereafter allegedly told one of his supervisors at the fast food establishment that he had a criminal record. Months later, codefendant employee brought a gun to work and showed it to several of his co-workers during their shift. At the end of his shift, co-defendant employee shot and wounded two of his co-workers and killed two other co-workers in a field about 300 yards from defendant's retail establishment. This case settled for a confidential amount on the day of jury selection.

Obtained a defense verdict in an aggravated assault by motor vehicle trial held in the Court of Common Pleas of Lehigh County. The truck driver client was involved in a serious accident with a passenger vehicle. He was approaching a red traffic signal when he realized that he could not apply the brakes in time to stop the tractor-trailer without jack-knifing. He activated his air horn in an attempt to notify other drivers at the intersection that he was unable to stop. There were two vehicles on either side of the intersection. Workers Compensation
In Lane Enterprises, Inc. v. W.C.A.B. (Patton), we argued that, in calculating the claimant's pre-injury average weekly wage under the Pennsylvania Workers' Compensation Act, an annual bonus should be pro rated. This position was accepted by the court. The claimant's attorney had argued that the bonus—paid in the last quarter of the year—should be considered as income earned during that particular quarter, which had the impact of substantially inflating the claimant's pre-injury average weekly wage.
