Child Support
Generally, all unsecured debts are discharged in a Chapter 7 except for family support, child support, debts based upon fraud, student loans and most taxes. Secured debt - such as a mortgage or a car loan - can be "reaffirmed", meaning that the debtor can agree to continue paying those debts in order to keep the home or the car that secures the debt.
Guardianship
Depending on the nature and extent of your assets, it costs no more than $300 - $800 to set up a revocable living trust, which is considerably less than the cost of a probate or guardianship proceeding.

Landlord-Tenant Disputes
The Wisconsin Administrative Code contains some provisions governing tenant rights and the responsibilties of landlords. For instance, if a tenant has a legitimate complaint, such as a lack of heat and reports the problem to the City Housing Authority, the landlord cannot respond with a retaliatory eviction.

Trusts
A revokable living trust is created by you to retain your assets before and after your death. During your lifetime, you will retain total control over your assets as the trustee of your trust. The trust will require that the successor trustee distribute the assets in the trust according to your wishes upon your death. If all of your assets are in the trust at the time of your death, there will be no need to probate your estate.
Power of Attorney
There are two types of Power of Attorney forms - one for allowing someone to help manage your financial affairs (Durable Power of Attorney) and another designating someone to make medical decisions for you in the event you become incapacitated (Power of Attorney for Health Care) You should have both types of Power of Attorney forms to protect you.
Probate

Bankruptcy
A Chapter 7 or Chapter 13 bankruptcy filing consists of a petition which requests the bankruptcy court for relief from creditors. Included with the petition are forms ("schedules") that list all real and personal property and all creditors. Also, the court requires a statement of monthly income, a statement of the basic household budget and a statement of financial affairs. The Chapter 7 and Chapter 13 schedules are basically the same; however, a Chapter 13 also includes the Chapter 13 plan in which the consumer tells the court how he or she intends to pay the listed debts and states the duration of the plan.
