Estate Planning
Our office drafts a variety of deeds depending on your specific need. We commonly draft Quit Claim Deeds, Warranty Deeds, and Lady Bird Deeds. Quit Claim and Warranty Deeds are the deeds commonly used to transfer property from one individual to another. A Lady Bird Deed is commonly used in estate planning and allows a person to keep the property in their control until that person dies at which time the property (if it is not sold before then) is then transferred to the person designated in the deed.

Michigan has made it possible for individuals to not only name who will make medical decisions for them in case they cannot do so themselves (regardless of whether the inability is short term, i.e. an unexpected turn of events while you are on the operating table, or long term) but also allow you to indicate what you want in terms of life support. Every adult should have a Durable Power of Attorney for Health Care (also known as a patient advocate designation). In the absence of such a designation, your loved ones may be forced to seek appointment of a guardian through the probate court to consent to medical care when you are not able to do so.

Bankruptcy
Our office only handles Chapter 7 Bankruptcy. In a Chapter 7 bankruptcy all of your dischargeable debts are eliminated. There are certain debts which will not be discharged, such as student loans. However, in order to file a Chapter 7 bankruptcy you need to have income under a certain level. The exact amount varies by the number of people you have in your household. Bankruptcy under Chapter 7 allows you to protect certain assets from the trustee. In most cases the exemptions are enough to protect most if not all of your property. What is not able to be exempted, the trustee sells and provides the money from that sale to your creditors in accordance with the bankruptcy code.
Tax Law
If a family member or a person you are caring for just passed away there are several things you should do. If your loved one was on Social Security, it is important to let Social Security know of the death so that they can stop payments, and you can avoid having to repay overpayments. It is also important to contact the employer if the person was still working to let them know and so you can figure out if there were any life insurance policies through the company or if your loved one is entitled to any other benefits (such as survivor spouse benefits). You will also want to contact the individual's health insurance company to make sure that the deceased person's coverage is discontinued, while making sure that everyone else on the plan continues to have coverage. It is also important to determine what bills the deceased person had so that certain bills can continue to be paid such as a mortgage. It is also important to get in touch with an attorney, accountant, and financial advisor so that you can determine whether you need to go through probate and to get all of the deceased person's real estate, bank accounts, stocks, and vehicles properly transferred, as well as make sure any tax issues are dealt with properly.
