Child Support
Thus, even though the guardian is granted full legal and physical custody of the child, and is responsible for making basic decisions about the child’s living environment and education, the parents still have a duty to support the child financially. A guardian is not obligated to support the child from the guardian’s own funds, so a local child support agency may be contacted about collecting support from the child’s parents.
Child Custody and Visitation
In California, three different branches of the court system make decisions about child custody. When there is a custody dispute between two parents over a child, that matter is heard in Family Court. If Child Protective Services is involved in removing the child from the custody of a parent, or if the child is a "dependent" or "ward" of the juvenile court, that matter is heard in Juvenile Court. When the court gives custody of a child under the age of 18, or the child's property, or both, to a non-parent adult relative or other caregiver, the matter is heard in Probate Court.

Wills may have additional limitations in certain nontraditional family groups, such as second marriages and gay and lesbian relationships. For example, if you want to leave your estate to your children from a previous marriage, a will alone may be insufficient as the sole estate conservation strategy if your spouse challenges it. In fact, most states require that your spouse receive a certain portion of your estate, often based on the length of the marriage.

Essentially, a probate guardianship is a court proceeding in which a judge gives someone who is not the parent custody of the child (called a "Guardianship of the Person") or the power to manage the child’s property (called a "Guardianship of the Estate.")

Estate Planning
Another technique you can use to control the distribution of your estate is establishing a trust. The use of a trust can minimize fees and taxes. Some trusts can completely avoid probate. Because trusts offer some unique advantages over other estate planning conservation methods, they may be the answer to many of your estate conservation needs.
Wills
A. Testamentary SNTs: included in the will and funded as part of the probate process of the Last Will and Testament.
Trusts
These trusts, called Supplemental Needs or Special Needs Trusts (SNTs), preserve government benefit eligibility and leave assets that will meet the supplemental needs of the person with a disability. The SNT funds those additional needs that go beyond food, shelter, and clothing and the medical and long term supports and services of Medicaid. In fact, the SNT must be designed specifically to supplement, not supplant, government benefits. Money from the trust cannot be distributed directly to the person with a disability. Instead, it must be distributed to third parties to pay for goods and services to be used by the person with a disability.
Power of Attorney
Just as an executor carries out your wishes in the distribution of your estate after your death, granting someone power of attorney gives a trusted individual the power and authority to act on your behalf in legal and financial matters if you should become incapacitated.
Probate
1. Probate is a method of transferring assets under court supervision as provided in a will, or if a person dies without a will, transferring assets under court supervision to heirs in accordance with sate law.
