Wrongful Death
ADM's School District Group represents numerous school districts in personal injury cases relating to the broadest spectrum of cases brought on behalf of students, parents, athletes, employees and the general public A sample of the matters handled by ADM include sexual and physical assaults, wrongful death claims, security claims, exposure claims involving lead and other contaminants, fear of AIDS, herpes and other diseases, premises liability matters, automobile cases, injuries occurring during athletic events, playground accidents, failure to properly supervise claims, and cases alleging civil rights violations. Premises Liability
Brendan Bertoli, an associate in ADM’s Albertson office, obtained summary judgment in a premises liability case venued in Supreme Court, Nassau County. Our client, a commercial office tenant, and was sued by its landlord after one of the tenant’s employees was hurt in a snow-and-ice slip-and-fall accident while walking into the office. We argued that as the Plaintiff’s employer, all common law claims were extinguished as Plaintiff did not suffer a grave injury. In addition, we argued, and the Court agreed, that the specific language of the indemnity clause in the lease was not triggered given the facts of the accident. As such, the third-party action was dismissed in its entirety.
Construction Litigation
Our Construction Defect Group has extensive experience in defending general contractors, construction managers, subcontractors, and design professionals in all aspects of litigation including coverage disputes. We work closely with both the Coverage and Appellate Groups to coordinate the defense of our clients and to prepare for all issues that arise throughout the lengthy litigation process associated with these types of claims.
Landlord-Tenant Disputes
Although the emphasis of our representation centers on negligence-type claims, we also provide certain clients with representation before administrative agencies, landlord-tenant, and in criminal proceedings involving building and fire code violations.
Property Damage
The Property Damage Group of ADM handles a wide range of property damage cases which present the potential for significant exposure to the client.
