Maritime workers have a high risk for on-the-job injuries no matter what their responsibilities. Crew members on typical large South Florida based cruise lines typically work up to ten hours a day, seven days a week for ten months a year. It is well-known that there is no "light duty" on a ship. Physical labor, severe weather conditions and inadequate medical care can all contribute to serious injuries or illnesses. Add to that, the long hours,, lack of proper work breaks, antiquated or broken equipment and the possibility of sexual harassment, and crew members face dangerous conditions on a daily basis. Cruise lines owe their employees a duty to provide a safe place to work.

Premises Liability
The cruise line sells shore excursions to passengers. They make a substantial commission doing so. But they try and insulate themselves from liability by making these shore excursion operators independent contractors. The cruise line has an obligation to select competent independent contractors. These contractors basically run all aspects of the shore excursions. They are not supervised by the cruise line. If they are not trained properly or are negligent in their duties, the cruise line may be held responsible if it was careless in selecting the shore excursion operator or it knew or should have known about dangers in areas off the ship where the passengers are expected to visit and which the passenger would not discover using reasonable care. The law says that the cruise line has a duty to warn passengers of the types of danger they could encounter on shore.
