Divorce
While you are in the process of divorcing, you typically cannot change the named beneficiaries on 401(k) plans or life insurance policies, though if needed you might be able to obtain an interim order to authorize a change. Once your divorce agreement is in place, it might state which beneficiary designations can and cannot be changed. Be sure to make the appropriate changes.
Premarital Agreement
When a person dies, many retirement accounts automatically pass to the person's spouse, unless the spouse has signed a waiver or disclaimer. This is true even if the person's will and prenuptial agreement state otherwise. Be sure you know where your retirement accounts will go if something happens to you. You should also review the beneficiary designations on life insurance policies, annuity contracts, and bank or brokerage accounts.
Guardianship
Like the case noted above, evidence was offered on both sides. The proponent offered evidence that the attorney and others said the decedent was able to speak normally and understood her surroundings. However, the parties objecting produced evidence from a guardianship proceeding and the testimony of a treating physician that the decedent lacked testamentary capacity.

Burglary
Another issue arises if a property sits empty for a long time. If a house isn't occupied, it may be hard to obtain insurance for it, and it may become subject to maintenance problems, burglary and vandalism.

The first of these needs can be accomplished using two simple documents: the health care proxy and the durable power of attorney. In the health care proxy you name an agent to make medical decisions for you; in the durable power of attorney you name someone to make financial decisions for you.

Third, as always, there are tax issues. When you pass away, there is an automatic basis step-up. That means the value of your home increases from the value at the time you bought it to the value at the time of your death. Your children will inherit it at its present value, without paying taxes on the increase in value. Transferring your home to children while you are still living does not avoid that tax.
